YOU AND ZUPAS EACH AGREE THAT CLAIMS AGAINST THE OTHER MAY ONLY BE BROUGHT IN YOUR OR OUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, CLASS ARBITRATION, CONSOLIDATED ARBITRATION, OR REPRESENTATIVE ACTION OR PROCEEDING. If a court or arbitrator determines that this class action waiver is unenforceable, then the arbitration agreement will not apply to that claim, and such claim shall be resolved in court subject to the jurisdiction provisions of these Terms.

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending the resolution of a dispute through arbitration.
